These Terms of Service define the rules for using the Terra Market platform (hereinafter referred to as the "Platform").

Terra Market is a technology platform for publishing listings and for contact between users. Terra Market is not a party to the sale agreement between the buyer and the seller.
The Platform serves as a technological intermediary, providing infrastructure for:
Terra Market is a marketplace for the terrarium industry, offering the following services:
Stripe Payments Europe, Ltd. processes TerraMarket checkout (Buy now) and payments for subscriptions and paid listings. A payment the buyer and seller arrange directly is not a TerraMarket payment and does not go through Stripe.
When a listing shows Buy now, payment for the animal goes from the buyer to the seller's connected Stripe account. Terra Market is not a party to that payment.
For TerraMarket checkout:
If a listing has no Buy now, the buyer can message the seller. Any payment (bank transfer, BLIK, PayPal, cash on pickup, or another method) is agreed between them, in messages. Terra Market does not publish a bank account, a PayPal identifier, or a BLIK phone number on the listing. Terra Market does not take that payment, does not confirm it, and does not record it as an order.
Payments for subscriptions (PRO/ELITE) and paid listings are also processed by Stripe.
The platform does not have access to users' payment funds and does not store payment card data.
To receive payouts from TerraMarket checkout, the seller must complete Stripe identity verification (KYC/AML).
The verification process includes:
Verification is conducted by Stripe as part of the onboarding process to Stripe Connect Express. Terra Market does not have full access to verification data - it only sees the verification status of the seller's account.
Until Stripe verification is complete, the seller does not receive payouts from TerraMarket checkout. That is not a ban on publishing a listing or on contact with a buyer.
TerraMarket fees for subscriptions and paid listings are on the price list. Current animal checkout does not add a separate service fee on top of the listing price.
All fees are visible before transaction confirmation. Fees for subscriptions and paid listings are non-refundable after service activation.
With Buy now, the buyer pays the order amount: the listing price and the selected shipping cost, or local pickup.
That amount is paid to the seller through Stripe as TerraMarket checkout. Terra Market does not currently add a separate service fee to it.
The seller is responsible for the animal, the description, legality, shipping, and returns. For TerraMarket checkout, the seller is the party to the Stripe payment. For a payment agreed in messages, the seller is still responsible for the animal and for that agreement. Terra Market is not a party to either agreement.
Terra Market is not responsible for:
Terra Market provides the listing, messages, and, when the seller has turned payments on, Stripe checkout. Claims about the animal, shipping, or a return go to the seller.
Right to withdraw from the agreement
According to Art. 38 para. 1 of the Consumer Rights Act, a consumer cannot withdraw from a service agreement if the service provider has fully performed the service with the explicit consent of the consumer, who was informed before the start of performance that after fulfillment of the service, they will lose the right to withdraw from the agreement.
In case of purchase of digital content (PRO/ELITE subscriptions):
The user can cancel the subscription at any time, which means it will not be renewed after the end of the current billing period. Cancellation of subscription does not entitle to a refund for the already paid period.

Access to selling features requires positive phone number verification via SMS. One phone number can be associated with only one User account to prevent fraud.
The user is legally obligated to possess and provide CITES documentation for protected species.
In the case of selling animals requiring CITES documents (Convention on International Trade in Endangered Species), the seller:
Terra Market reserves the right to change the Terms of Service. Changes come into effect after publication on the Platform. Continued use of the Platform after changes are introduced means acceptance of them.
In matters not regulated by these Terms of Service, Polish law provisions apply.
TerraMarket checkout (Buy now) goes through Stripe to the seller's connected account. After that payment is completed, Terra Market does not refund it. A refund of that payment is between the buyer and the seller.
This applies only to an order paid through TerraMarket.
