1. General Provisions

These Terms of Service define the rules for using the Terra Market platform (hereinafter referred to as the "Platform").

2. Platform Nature and Type of Services

Terra Market is solely a technological platform that enables users to publish listings and conduct transactions. Terra Market is not a party to the sales agreement between the buyer and seller.

The Platform serves as a technological intermediary, providing infrastructure for:

  • Publishing animal sales listings
  • Establishing contact between buyers and sellers
  • Processing payments via Stripe Connect system
  • Managing orders and communication

Services offered by Terra Market

Terra Market is a marketplace for the terrarium industry, offering the following services:

  • PRO Subscription: 49.90 PLN / month - 50 listings / month, 5 photos per listing, priority support
  • ELITE Subscription: 149.00 PLN / month - unlimited listings, 10 photos per listing, PDF passport generator, API access
  • Paid listings: 3.00 PLN per single listing

3. Payment System

The payment operator is Stripe Payments Europe, Ltd. All payments for products (animals), subscriptions, and paid listings are processed by Stripe.

Transactional Model - Direct Charges (Direct Payments)

Terra Market is a platform connecting transaction parties. Payment for products (animals) goes directly from the Buyer to the Seller's Connected Account in the Stripe Connect system.

This means that:

  • Payment is processed directly on the seller's account in Stripe
  • Terra Market does not intermediate in product payments - it only serves as a technological platform
  • The seller is the direct party to the payment transaction in the Stripe system
  • The buyer makes payment directly to the seller through Stripe Checkout

Payments for subscriptions and listings

Payments for subscriptions (PRO/ELITE) and paid listings are also processed by Stripe.

  • Credit/debit card payments, BLIK, and other methods supported by Stripe
  • Bank statement description: TERRAMARKET.EU
  • All transactions are secure and encrypted
  • The platform does not store payment card data - all data is processed by Stripe

The platform does not have access to users' payment funds and does not store payment card data.

4. Seller Verification (KYC/AML)

To receive payouts, sellers must complete identity verification through Stripe (KYC - Know Your Customer / AML - Anti-Money Laundering).

The verification process includes:

  • Verification of personal data (name, surname, address)
  • Verification of identity document (ID card, passport)
  • Verification of bank account data (for payouts)
  • Additional checks according to regulatory requirements

Verification is conducted by Stripe as part of the onboarding process to Stripe Connect Express. Terra Market does not have full access to verification data - it only sees the verification status of the seller's account.

Sellers cannot receive payouts until they complete the Stripe verification process.

5. Fees and Commissions

Terra Market may charge sellers a commission for using the platform. Details regarding fees are available in the seller panel.

All fees are visible before transaction confirmation. Fees for subscriptions and paid listings are non-refundable after service activation.

The Service Fee is non-refundable after initiating the payment transaction.

For product (animal) transactions, Terra Market charges a Service Fee for technological transaction processing. This fee:

  • Is added to the product price before purchase confirmation
  • Is non-refundable after initiating the payment process (after clicking "Buy now" and creating an order)
  • Constitutes a fee for the platform's technological infrastructure
  • Is not subject to refund, even if the transaction is canceled by the buyer or seller

6. Liability

The Seller is responsible for product quality, shipping, and any returns, as the direct party to the transaction in the Stripe Connect system.

Terra Market is not responsible for:

  • Quality, condition, or compliance with description of products offered by sellers
  • Transaction fulfillment between buyer and seller
  • Any disputes between users
  • Actions or omissions of sellers or buyers
  • Product shipping and any delays
  • Returns and complaints - these are handled directly between buyer and seller

Terra Market only provides technological infrastructure for establishing contact and processing payments. Any claims related to the transaction should be directed directly to the seller, who is the party to the sales agreement.

7. Right of Withdrawal

Right to withdraw from the agreement

According to Art. 38 para. 1 of the Consumer Rights Act, a consumer cannot withdraw from a service agreement if the service provider has fully performed the service with the explicit consent of the consumer, who was informed before the start of performance that after fulfillment of the service, they will lose the right to withdraw from the agreement.

In case of purchase of digital content (PRO/ELITE subscriptions):

  • The user loses the right to withdraw from the agreement at the moment of full service performance
  • Full service performance occurs at the moment of activation of premium features (PRO or ELITE plan)
  • After subscription plan activation, the user immediately receives access to all premium features
  • Therefore, the right to withdraw from the agreement expires at the moment of subscription activation

The user can cancel the subscription at any time, which means it will not be renewed after the end of the current billing period. Cancellation of subscription does not entitle to a refund for the already paid period.

8. User Rights and Obligations

Users are obliged to:

  • Provide true and current data
  • Comply with legal provisions, especially regarding animal trade
  • Possess required permits and documents (e.g., CITES)
  • Use the Platform according to its intended purpose
  • Complete Stripe Connect verification (for sellers wishing to receive payouts)

Account Verification

Access to selling features requires positive phone number verification via SMS. One phone number can be associated with only one User account to prevent fraud.

CITES Documentation Obligations

The user is legally obligated to possess and provide CITES documentation for protected species.

In the case of selling animals requiring CITES documents (Convention on International Trade in Endangered Species), the seller:

  • Is legally obligated to possess valid CITES documents before publishing a listing
  • Must submit CITES documents for verification by the platform administrator
  • May publish a listing only after positive verification of CITES documents
  • Is responsible for CITES document compliance with international and national law
  • Must provide CITES documents to the buyer after transaction completion

9. Final Provisions

Terra Market reserves the right to change the Terms of Service. Changes come into effect after publication on the Platform. Continued use of the Platform after changes are introduced means acceptance of them.

In matters not regulated by these Terms of Service, Polish law provisions apply.

10. Buyer Protection

Terra Market does not intermediate in product payments. Payments go directly to the seller's account (IBAN) through the PISP system (Open Banking). The platform cannot refund funds after transaction completion.

Due to Terra Market's business model, where payments go directly to the seller's account:

  • The platform does not intermediate in product (animal) payments - payments are processed directly through the PISP system (Open Banking) to the seller's bank account (IBAN)
  • Terra Market cannot refund funds after transaction completion - refunds must be handled directly between the buyer and seller
  • The platform does not guarantee product quality or transaction fulfillment - responsibility lies solely with the seller
  • Any disputes regarding transactions (product quality, shipping, returns) should be directed directly to the seller

Recommendations for buyers:

  • Check seller verification ("Verified" badge) before making a purchase
  • Check seller reviews and ratings in the profile
  • Use secure payment methods (PISP with bank authorization)
